Benjamin H. Hathaway is a litigator with nearly thirty-five years of experience. He focuses his practice on complex commercial, partnership, and healthcare litigation. Ben’s clients have included physicians, hospitals, banks, credit unions, partnerships, nonprofit corporations, local governmental entities, dentists, energy companies, and other individuals and business entities.
Ben has successfully represented clients throughout Texas and elsewhere in federal and state court actions, arbitration proceedings, and administrative matters. He has provided counseling and forceful representation for his clients in disputes concerning fiduciary obligations, antitrust issues, provider reimbursement issues, Stark issues, breaches of contract, note collections, partnerships, employment, insurance coverage, real estate, and defamation.
Ben grew up in Port Arthur, Texas but moved to Austin to attend the University of Texas School of Law. He and his family have lived here since that time, except for the year immediately after law school he spent clerking for a federal district judge in New York City. Ben has been active as a leader in his children’s Cub Scout pack, Boy Scout troop, and Venture Crew. He also helped coach their T-ball, baseball, softball, and basketball teams, perhaps contributing to their decisions to forego careers as professional athletes.
